LIMITED WARRANTY OF PRODUCT

Scherba Industries, Inc. warrants to its customers that the products sold by Scherba Industries, Inc. are free from defects in materials and workman-ship and that for a period of six(6), twelve(12) or twenty-four(24) months from the date of manufacture which shall be fixed at the date of shipment from the factory, any substantial defects in materials or workmanship that become evident will be repaired or replaced by Scherba Industries, Inc. provided that the Products are used in accordance with the currently published instructions outlining proper installation, maintenance, cleaning, storage, and repair processes, and providing that the Products are used only for their intended use.

Changes in the color and non-decorated portions of the Product such as darkening, staining, streaking or other blemishes caused by the accumulation of dirt, bird deposits, water runoff, or other airborne particles are not covered under this warranty.

Fading of fabric colors or graphics colors are not covered under this warranty except if any colors fade excessively due to the extent that the display is ineffective and unrecognizable when observed from a normal viewing distance, this warranty will provide for the repiar or replacement within the first six(6), twelve(12) or twenty-four(24) months of normal use from the date of shipment from the factory.

Any claim for warranty repair or replacement must be made promptly in writing, state the details of the claim, the date the defect was first observed, and include proof of purchase. In the event of any notice of defect, and upon inspection and approval by Scherba Industries, Inc., Scherba Industries, Inc. will, at its option, either repair the product or furnish a duplicate product to the customer at the customer's expense on the current price schedule for that Product with a prorated allowance equal to 1/6,1/12, or 1/24th of the original purchase price of the Product for each month remaining in the initial six(6), twelve(12) or twenty-four(24) months period from the date of shipment in exchange for the original product. If Scherba Industries, Inc. elects to repair the product, then at its sole discretion the product will be repaired either at Scherba Industries, Inc. factory or at the distribution point, to reasonable operating condition by replacing the materials as may be needed. Any repair to a Scherba Industries, Inc. product will only be performed at a Scherba Industries, Inc. factory or authorized repair facility with all inbound and outbound shipping charges borne by the customer.

No other express or implied warranty is given with respect to the products covered by this warranty. Manufacturer specifically disavows any other representation, warranty or liability for direct consequential damages relating to the condition or use of the product. No replacement, allowance or warranty repair will be made for any product which has been damaged by willful or negligent mishandling, chemical damage, acts of God or circumstances which would be reasonably insurable by the product user. Manufacturer's liability under this warranty shall be limited to replacement or repair of the product stated herein. The warranty shall not apply to expendable components such as fuses, bulbs or similar replacement parts. All inflation fans have a one(1) year manufacturers warranty.
